Private memberships

Terms and
conditions.

Plain English, so you know exactly what you're applying for.

These terms apply when you apply for a private membership at LUXGYM, Cooroy, trained and coached by Di-Fit. Applying means you've read and understood them. If you're accepted, you'll also sign a written membership agreement that sets out the final details, including your fees.

1How membership works

  • Membership is by application. It's a private, small-group community, and spaces are limited.
  • Submitting an application doesn't guarantee a place. We read every application personally, and we assess each one on the same things: training experience, goals, availability and whether the space suits you safely.
  • If we receive more applications than we have spaces, we'll offer you a place on our waiting list. Not being offered a place right away says nothing about you personally.
  • Accepted members receive a written membership agreement before they start. Nothing is binding until you sign it.

2Minimum commitment and fees

  • Memberships have a 6-month minimum term, starting on your start date.
  • After the minimum term, your membership continues until you or we end it with written notice, as set out in your agreement.
  • We'll give you a written statement of every fee and charge before you sign. We won't charge anything that isn't in that statement.
  • You'll have a short cooling-off period after you sign, as set out in your agreement.

3Hours and access

  • The studio is open to members from 6am to 8pm. It's not a 24-hour gym, and members can't enter outside these hours.
  • Access is personal. Please don't share your access details or let anyone in who isn't an approved member.
  • To keep the room calm, we may ask members to book sessions and may limit how many people are in the studio at one time.
  • We may close or change hours for public holidays, maintenance, severe weather, emergencies or health directions. We'll give as much notice as we can.
  • Guests are welcome only with our approval beforehand.

4Your health and safety

  • You must be 18 or over to apply.
  • Your application includes a health check. Please answer it honestly and fully. Tell us before your next session if your health changes, including any new injury, illness, medication, surgery or pregnancy.
  • A "yes" to a health question doesn't rule you out. It may mean we ask for a note from your doctor before you start, or that we adjust your training.
  • Please don't train if you're unwell, have been told not to exercise, or are under the influence of alcohol or drugs.
  • Our coaches are not medical practitioners. Training advice isn't medical advice, and it doesn't replace seeing your doctor.

5Being part of the community

  • Treat every member and coach with respect. No harassment, bullying or discrimination.
  • Respect other members' privacy. Don't photograph or film anyone without their consent, and don't share who trains here.
  • Bring a towel, wipe down equipment after use, and re-rack weights and accessories.
  • Arrive clean, in clean training clothes and enclosed athletic shoes.
  • Use the shared shower, toilet, kitchen, fridge and coffee machine considerately, and leave them as you'd like to find them.
  • No alcohol, illegal drugs, performance-enhancing substances or weapons on the premises.
  • Members don't offer personal training or other paid services to other members at the studio.

6Risk of injury

Please read this. Strength training, conditioning and cardio carry an inherent risk of injury and, in rare cases, serious injury, illness or death. Risks include strains, sprains, fractures, falls, being struck by equipment or weights, cardiac events and aggravation of existing conditions. Some risks can't be removed even when reasonable care is taken.

  • You take part voluntarily and accept the obvious and inherent risks of the activity.
  • You're responsible for training within your limits, using correct technique, and stopping if you feel pain, dizziness or discomfort.
  • Our services come with guarantees under the Australian Consumer Law that can't be excluded, including that they'll be provided with due care and skill. Nothing in these terms takes away any right you have that the law doesn't allow us to exclude.
  • Where the law allows, we exclude liability for death or personal injury caused by a failure to provide our services with due care and skill. This doesn't apply to significant personal injury caused by our reckless conduct. Your membership agreement sets this out in full.

7Equipment and belongings

  • We maintain the studio and equipment in a safe condition. Please check equipment before you use it and don't use anything that looks damaged or is marked out of service.
  • If you damage equipment through misuse or careless conduct, you may need to cover the reasonable cost of repair or replacement.
  • You bring your belongings at your own risk, except where a loss is caused by our negligence.

8Privacy and your information

  • We collect the information in your application, including health information, to assess your application, keep you safe while training, tailor your training and contact you about your membership.
  • It's stored securely, seen only by the people who need it, and never sold.
  • We share it only with your consent, with emergency services or medical providers in an emergency, with our insurers or advisers in connection with a claim, or where the law requires.
  • You can ask to see or correct your information at any time by contacting us.
  • We won't photograph or film you, or use your image in marketing, without your separate written consent. You can withdraw consent for future use at any time.

9Suspending or ending a membership

  • We may suspend your access straight away while we look into a safety concern.
  • We may end a membership if there's a serious or repeated breach of the community rules, false or misleading information in an application, an unpaid amount after a written reminder, or training without a doctor's clearance we've required.
  • We may also end memberships if the studio closes or the program ends, by giving you at least 30 days' written notice and refunding any fees paid for the period after it ends.
  • How you can suspend or end your own membership is set out in your agreement.

10General

  • These terms apply to your application. Once you're accepted, your signed membership agreement, fee statement and studio rules apply to your membership.

  • If you have a concern, please contact us first on 0419 322 243 or di@di-fit.com.au. We'll work to sort it out quickly. You can also contact the Queensland Office of Fair Trading.
